Welcome to Foodex ("we," "our," or "us"). This User Agreement ("Agreement") governs your use of the Foodex mobile application (the "App") on iOS devices, including all features, updates, and related services we provide. By downloading, installing, accessing, or using Foodex, you agree to comply with and be bound by this Agreement.

If you do not agree to the terms herein, you should not access or use the App.

Use of the App:

Our app is intended for personal use of food calories counter.

Privacy:

We value your privacy and are committed to protecting your personal information. Please refer to our privacy policy for more details.

Intellectual Property:

All content and materials on the app, including text, graphics, logos, images, and software, are the property of our company or licensors and are protected by copyright and other intellectual property laws. You may not use or reproduce any content without our prior written consent.

User Conduct:

You agree to use the app lawfully and appropriately, refraining from engaging in illegal or harmful activities or infringing upon the rights of others.

Disclaimer of Warranties:

The app is provided "as is" without any warranties, whether express or implied. We do not guarantee the app will be error-free or uninterrupted, or that the information provided will be accurate or complete.

Limitation of Liability:

We are not liable for any damages arising from the use of the app, including direct, indirect, incidental, consequential, or punitive damages.

Indemnification:

You agree to indemnify and hold us harmless from any claims, damages, or expenses related to your use of the app.

Changes to the Terms of Service:

We reserve the right to modify or update these terms of service without prior notice. Your continued use of the app after any changes constitutes acceptance of the new terms.

Governing Law:

These terms of service are governed by the laws of the jurisdiction in which our company is located.

 

In-App Purchases and Payments

The Foodex app will be distributed and released globally through the Apple App Store and. However, certain features and limitations of the Foodex app will be available to users as paid features through in-app purchases. If you wish to use such paid features under this agreement, you must pay in advance.

 

These in-app purchases are available on an annual, semi-annual, quarterly, monthly, or weekly basis and are automatically renewed annually or monthly by the Apple App Store and/or Google Play on an auto-renewal model until the user cancels their subscription. The Apple App Store and/or Google Play will send an email in advance prior to renewal, containing a hyperlink to manage your subscription plan. Payments for the app are processed through the Apple App Store and/or Google Play where you initially downloaded the app. You can view the applicable in-app purchase rules and policies directly from the Apple App Store and/or Google Play. You acknowledge and agree that you are solely responsible for managing your in-app purchases and the amount you spend on in-app purchases within the Foodex app.

Please note that to purchase content or Foodex apps on Google Play, you need a Google Payments account and agree to Google Payments' terms and conditions. Google Payments' privacy statement applies whenever you use your Google Payments account to purchase content. You are responsible for all amounts payable on all purchases made through your Google Payments account on Google Pay. In addition to Google Payments, Google may offer other payment methods to help you purchase content or Foodex apps through Google Play. You are bound by all applicable terms and conditions or other legal agreements, whether with Google or a third party, and your use of a particular payment method is subject to such rules. Google may add or remove payment methods at any time. You are solely responsible for all amounts payable on all purchases made on Google Play.

 

To determine your eligibility to purchase content or Foodex apps through your device and be billed through your network operator's account, Google Play sends your device identifier to your network operator when you create a Google Play account on your device. For this, you need to accept your network operator's terms of service. Your network operator may send us your billing address information. Google Play retains and uses this information in accordance with Google's Privacy Policy and Google Payments Privacy Statement.

 

If you are under 18 years of age, you are legally required to obtain permission from your parent or legal guardian before making any in-app purchases. Completing an in-app purchase acknowledges to us that you have all the necessary permissions to make such a purchase. If you are a parent or legal guardian of someone under 18 years of age and are concerned that your child may be overusing in-app purchases, we recommend that you consider using the parental controls available on the Apple Store and/or Google Play.

 

In-app purchases are charged by the Apple Store or Google Play, not Foodex . These purchases are subject to the terms and conditions of the Apple Store and/or Google Play. All billing and refund inquiries should be made directly to the Apple Store and/or Google Play. Foodex does not have access to your Apple Store and/or Google Play account and transaction history. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time via your Apple device settings.

 

If an in-app purchase fails to download or is unusable after successful download, we will investigate the cause immediately upon discovering the problem or receiving your notification. We will decide, based on the circumstances, whether to provide an alternative to the in-app purchase or to provide a patch to fix the issue. In either case, we will not charge any fees for replacing or repairing in-app purchases. If we are unable to replace or repair the relevant in-app purchase, or are unable to complete this process within a reasonable timeframe without causing you significant inconvenience, we will authorize the Apple App Store and/or Google Play to process a refund for you, up to the cost of the relevant in-app purchase. You can also contact the Apple App Store and/or Google Play directly to request a refund.

 

You acknowledge and agree that all billing and transaction processes are handled by the Apple App Store and/or Google Play where you downloaded the Foodex app, and are subject to the Apple App Store and/or Google Play Terms and Conditions/End User License Agreement. If you encounter any payment issues related to in-app purchases, please contact the Apple App Store and/or Google Play directly.
